Terms of Service

Last updated: March 2026.

These Terms of Service ("Terms") govern your access to and use of open-au.com and related services provided by Open-AU (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service.

By using the Service, you represent that:

  • You are at least 18 years old
  • You have the legal capacity to enter into a binding agreement
  • If you act on behalf of an organisation, you are authorised to bind that organisation

2. Description of the Service

Open-AU is a regional information platform designed to help working holiday travellers plan regional work experiences in Australia.

The Service may include:

  • Regional location profiles and planning information
  • AI-assisted geographic compatibility features, including Astro
  • Educational content, guides, and related planning resources
  • Free or paid access to certain features

Open-AU is not:

  • A job board
  • A recruitment agency
  • An employment placement service
  • A migration agent
  • A provider of professional legal, migration, financial, or employment advice

Location information is provided for historical and planning context only. It does not represent live vacancies or guaranteed work availability.

3. Accounts and Security

To access certain features, you may need to create an account.

You agree to:

  • Provide accurate and current information
  • Maintain the security of your credentials
  • Notify us promptly of suspected unauthorised access
  • Accept responsibility for activity under your account to the extent caused by your failure to keep credentials secure

We may suspend or restrict accounts where reasonably necessary, including where an account creates security, fraud, abuse, or legal risk.

4. Free Features, Paid Features, and Billing

4.1 Free Access and Credits

We may provide free credits, trial access, or limited free usage for certain features.

Free credits or free usage allowances:

  • May change, expire, reset, or be removed
  • Are non-transferable
  • Have no cash value
  • Are governed by the plan rules shown in the Service at the time of use

4.2 Paid Features and Subscriptions

Some features are available only through a paid subscription or other paid access model.

Pricing, billing intervals, and plan details will be shown before checkout.

Open-AU uses Creem or another authorised Merchant of Record ("MoR") or billing provider for payment processing, tax handling, invoicing, subscription administration, and certain refund functions.

The Merchant of Record acts as the seller of record for checkout and billing purposes. Charges may appear on your statement under the Merchant of Record's name, including CREEM.IO* STORE where Creem is used.

You may also be required to agree to the Merchant of Record's own terms and privacy policy during checkout.

4.3 Plan Changes (Upgrades and Downgrades)

You may upgrade or downgrade your subscription plan at any time through your account dashboard.

Upgrades take effect immediately. When you upgrade:

  • A prorated charge is calculated as: new plan price minus the unused value of your current plan
  • This amount is automatically charged to your saved payment method — you will not be asked to re-enter payment details
  • Your billing cycle resets to begin from the date of upgrade
  • Your bank may place a temporary pre-authorisation hold for an amount different from the final charge; this is standard banking practice and the hold will be released automatically
  • Credits associated with the new plan are applied immediately
  • The exact charge is calculated to the second by the payment processor and may differ slightly from manual estimates

Downgrades take effect at the end of the current billing period. When you downgrade:

  • You retain access to your current plan's features and credits until the end of the paid period
  • At the start of the next billing period, your plan, credits, and billing amount will adjust to the new plan
  • No partial refund is issued for the remaining period on the higher plan

Plan changes are processed through the Merchant of Record. Open-AU does not store or access your payment card details directly.

4.4 Cancellation

You may cancel a recurring subscription at any time through:

  • Your account settings, where available
  • The hosted billing or customer portal made available with your subscription
  • The Creem Customer Portal, where applicable: https://creem.io/my-orders/login

Unless otherwise stated at checkout, cancellation takes effect at the end of the current billing period. You will retain access until the end of the paid period and will not be charged again after cancellation takes effect.

4.5 Refunds

Fees are generally non-refundable except:

  • Where required by applicable law
  • Where a refund is granted under the Merchant of Record's policies or obligations
  • Where we choose to resolve a customer issue through a refund or credit

If you have a billing issue or believe a refund should be considered, contact support@open-au.com as soon as possible and include your checkout email and transaction details.

Nothing in these Terms limits any non-excludable rights you may have under applicable consumer protection law.

4.6 Price Changes

We may change pricing from time to time. If a price change affects an existing recurring subscription, we will provide reasonable notice before the change takes effect.

5. Location Information

Location profiles and regional planning information are provided for informational purposes only.

Open-AU does not verify, endorse, or guarantee:

  • Current job openings
  • Employer conduct
  • Pay rates
  • Accommodation quality
  • Transport availability
  • Visa eligibility outcomes
  • Work availability in any specific region

You are responsible for independently verifying relevant information before travelling, relocating, or making commitments.

6. AI-Assisted Features

Astro and other AI-assisted features generate outputs using third-party AI systems through Open-AU's own interface.

AI-assisted outputs:

  • Are provided for informational and entertainment purposes only
  • Do not constitute legal, migration, employment, financial, medical, or psychological advice
  • Do not constitute fortune telling, psychic readings, or guaranteed predictions
  • May be incomplete, inaccurate, or unsuitable for your circumstances

Open-AU is an independent service and is not affiliated with, endorsed by, or sponsored by the providers of the AI models used in the Service.

You should not rely solely on AI-assisted outputs when making significant travel, work, visa, or financial decisions.

7. Acceptable Use

You must not use the Service to:

  • Violate law or regulation
  • Infringe third-party rights
  • Scrape, mirror, extract, or redistribute protected content without permission
  • Circumvent authentication, payment controls, rate limits, or security protections
  • Introduce malware or harmful code
  • Use bots or automated systems without authorisation
  • Generate, request, or attempt to generate illegal, sexually explicit, harmful, or abusive content through the Service
  • Interfere with the normal operation of the Service

We may investigate misuse and take reasonable action, including restricting or terminating access where appropriate.

8. Intellectual Property

Unless otherwise stated, the Service and its software, branding, design, and content are owned by or licensed to Open-AU and protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, lawful, non-commercial purposes.

You retain ownership of content and personal data you submit, but you grant us the rights reasonably necessary to host, process, and display that content to operate the Service.

9. Disclaimer of Warranties

To the extent permitted by law, the Service is provided on an "as is" and "as available" basis.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or suitable for every purpose, or that information or outputs obtained through the Service will always be accurate or current.

Nothing in these Terms excludes any guarantee, warranty, or right that cannot lawfully be excluded.

10. Limitation of Liability

To the extent permitted by law, Open-AU will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Service.

To the extent permitted by law, our aggregate liability for claims arising out of or relating to the Service will be limited to the greater of:

  • The amount you paid for the Service in the 12 months before the event giving rise to the claim, or
  • AUD $100

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Suspension, Termination, and Discontinuation

You may stop using the Service at any time.

We may suspend, restrict, or terminate access where reasonably necessary, including where:

  • You materially breach these Terms
  • Your use creates fraud, abuse, security, or legal risk
  • We are required to do so by law or by a service provider relationship affecting the Service

We may also modify, suspend, or discontinue part or all of the Service. If we discontinue a paid feature, we will act reasonably and address outstanding prepaid access in accordance with applicable law and provider arrangements.

Provisions that by their nature should survive termination will continue to apply, including provisions relating to liability, intellectual property, and accrued rights or obligations.

12. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia, unless mandatory law in your place of residence provides otherwise.

Before starting formal proceedings, the parties agree to try to resolve disputes in good faith.

13. Changes to These Terms

We may update these Terms from time to time. When material changes are made, we will update the "Last updated" date and may provide additional notice through the Service or by email where appropriate.

If you do not agree to the revised Terms, you must stop using the Service.

Third-Party Services and Availability

The Service depends on third-party infrastructure and service providers, including hosting, authentication, AI, analytics, mapping, and billing providers.

As a result, parts of the Service may be interrupted, delayed, changed, or unavailable from time to time. We do not guarantee uninterrupted or error-free availability.

Payments and Billing

Payments for paid features are processed by Creem or another authorised Merchant of Record or billing provider. Charges may appear under the provider's name rather than Open-AU.

The Service may contain links to third-party websites or resources. We do not control or take responsibility for the content, availability, privacy practices, or terms of third-party sites.
